Matrimonial Cases/disputes –between husband and wife are the result of the ego problem, intolerance, temperamental differences, zero tolerance and high expectations as per my experience. Advice -If you are tired of relationship and it is nothing more than carrying the name tag of the spouse, get rid of such suffocating relationship.

Petition for restitution of the Conjugal Rights under Section 9 of the Hindu Marriage Act -Divorce petition under section 13 of the Hindu Marriage Act. Can file petition for judicial separation under section 10 of the Hindu Marriage Act.

What is the way to get Divorce?

There are two ways to get divorce- 1). Mutual divorce i.e. divorce with the consent of the husband and wife under section 13(B) of Hindu Marriage Act. Easiest and fastest way to get the decree of the Divorce. Condition applied-both must have been living separately for more than at least one year. Limitation-cannot be filed before completion of one year of the marriage. 2). Contested Divorce i.e. divorce on merits of the case on the basis of the different grounds mentioned/provided under Hindu Marriage Act, 1955. Total thirteen grounds are there for Divorce.
